When Is the Trucking Company Liable for Truck Driver Fatigue or Inattention?

When trucking companies turn a blind eye to drivers who operate over-hours, who have a history of speeding to make up time and miles, or who lie about hours, rest time or speed, they can be held liable if truck driver fatigue causes a serious or fatal accident. Trucking companies can also be held liable for:

  • Setting routes that they know a driver cannot possibly complete in time without speeding or driving over the number of hours allowed
  • Allowing or even encouraging drivers to use onboard e-mail devices or texting while driving to communicate with the home office
  • Tampering with onboard computer lockout devices that prevent the use of onboard computers while the truck is in motion so drivers can utilize the e-mail features while driving
  • Ignoring reports of drunk driving or drug abuse
  • Failing to audit logbooks or ignoring evidence of over-hours or over-miles driving

In one of our representative case results, a truck driver rear-ended our client, causing an explosion that resulted in her death. After vigorous investigation, we found that the company had disabled the computer lockout device to allow drivers to communicate with the home office while driving. This practice had gone on for more than 10 years, and the company refused to change its practice even with multiple wrecks and deaths prior to our case. After refusing to accept significant settlement offers, we were prepared to try the case. A few days before trial, we learned that the company had ended its practice of disabling the lockout device and we agreed to a confidential multimillion-dollar settlement.
